I have filing questions related to a workers' comp head of household situation. My disabled brother can't live alone, so he lives with me. If he gets workers' compensation but I pay most of his expenses, can I file taxes as head of household?

Your brother's workers' compensation income won’t count in determining if you can file return as head of household. You can file as head of household if all these apply:

  • When filing taxes, you claimed your disabled brother as a dependent, or he meets the requirements to be your qualifying child due to his disability.
  • He lived with you for more than half the year.
  • You provided more than half the cost of keeping up the home where you both live.
