The Internal Revenue Service (IRS) considers you married for the entire tax year if you have no divorce decree or legal separation agreement by December 31. So, if you&#8217;re separated, you are still legally married and you must still file taxes as a married couple. While you may think you should file a separate tax return, or file as Single, your filing status should generally be either:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.hrblock.com\/tax-center\/around-block\/offers\/tax-filing-status-guide\/\"><strong>Married filing jointly<\/strong><\/a> (MFJ)<\/li>\n\n\n\n<li><a href=\"https:\/\/www.hrblock.com\/tax-center\/filing\/personal-tax-planning\/claiming-married-and-filing-separately\/\"><strong>Married filing separately<\/strong><\/a> (MFS)<\/li>\n<\/ul>\n\n\n\n<p>There are some exceptions, however. If your spouse was not a member of your household during the last six months of the tax year, and you meet additional IRS requirements to be considered unmarried for tax purposes, you may be able to file as <a href=\"https:\/\/www.hrblock.com\/tax-center\/filing\/credits\/claiming-head-of-household-with-no-dependents\/\">Head of Household<\/a> even if you don&#8217;t have a legal separation or divorce decree. Depending on your specific tax situation, you may benefit more from one status than the other.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Pros and cons of married filing separately<\/h3>\n\n\n\n<p>When filing separate returns, you won\u2019t be responsible for each other\u2019s tax liability, but you and your spouse still have to decide together whether to claim the <a href=\"https:\/\/www.hrblock.com\/tax-center\/filing\/adjustments-and-deductions\/standard-vs-itemized-deductions\/\">Standard Deduction or itemize deductions<\/a>. You\u2019ll also probably lose access to some tax benefits and pay more in tax.<\/p>\n\n\n\n<p>If you decide to file separately, you might be eligible for the <a href=\"https:\/\/www.hrblock.com\/tax-center\/filing\/credits\/claiming-head-of-household-with-no-dependents\/\">Head of Household (HoH) filing status<\/a>, which can come with some financial benefits. The HoH filing status applies to you when all of these are true:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Your spouse didn\u2019t live in your home during the last six months of the year. (Your spouse is considered to have lived in your home even if he or she is temporarily absent but expected to live there at some point in the future.)<\/li>\n\n\n\n<li>You paid more than half the costs of keeping up your home for the year.<\/li>\n\n\n\n<li>Your home was the main residence for more than half the year for:<ul><li>Your child,<\/li><\/ul><ul><li>Your stepchild, or<\/li><\/ul>\n<ul class=\"wp-block-list\">\n<li>Your eligible foster child, and<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>You\u2019re able to claim the above-mentioned child as a dependent.<\/li>\n<\/ul>\n\n\n\n<p>You\u2019ll still meet this test if you can\u2019t claim the child as a dependent only because the noncustodial parent can claim the child under the rules for divorced or separated parents.<\/p>\n\n\n\n<p><strong>Note<\/strong>: Personal and dependent exemptions have been eliminated from the tax code. However, you can still qualify for tax benefits based on having a dependent child, such as the HoH filing status mentioned above.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Pros and cons of married filing jointly when separated<\/h3>\n\n\n\n<p>Certain tax credits like the <a href=\"https:\/\/www.hrblock.com\/tax-center\/filing\/credits\/earned-income-credit\/\">Earned Income Tax Credit<\/a> (EITC), <a href=\"https:\/\/www.hrblock.com\/tax-center\/filing\/credits\/child-and-dependent-care-credit\/\">Child and Dependent Care Credit<\/a>, and credits for higher education are generally available only if married couples file a joint tax return, with some exceptions. However, if you file a joint return, both you and your spouse have joint and separate liability.<\/p>\n\n\n\n<p>This means:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Both of you are responsible for the taxes, interest, and penalties due on the return.<\/li>\n\n\n\n<li>You\u2019d both be responsible for any underpayment of tax that might be due later.<\/li>\n\n\n\n<li>If one spouse doesn\u2019t pay the tax due, the other might have to.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Tax deadline for separated taxpayers<\/h3>\n\n\n\n<p>If you\u2019re questioning \u201c<a href=\"https:\/\/www.hrblock.com\/tax-center\/irs\/deadlines-and-extensions\/tax-deadlines\/\">What is the last day for filing taxes<\/a>?\u201d the date is the standard&nbsp;<a href=\"https:\/\/www.hrblock.com\/tax-center\/irs\/deadlines-and-extensions\/tax-deadlines\/\">tax deadline<\/a>&nbsp;for individual taxpayers.
