Understanding what is a 1041, who must file it, and when it\u2019s due can help you stay compliant and avoid penalties.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is a 1041?<\/h2>\n\n\n\n<p>Form 1041 is the IRS income tax form used to report income earned by an estate or trust.<\/p>\n\n\n\n<p>The 1041 form is officially called U.S. Income Tax Return for Estates and Trusts. It reports income, deductions, gains, losses, and distributions for estates and trusts that generate income during the tax year.<\/p>\n\n\n\n<p>When income is distributed to beneficiaries, the estate or trust reports those distributions on <a href=\"https:\/\/www.hrblock.com\/tax-center\/irs\/forms\/schedule-k-1\/\">Schedule K-1<\/a> (Form 1041). For trusts, Form 1041 reports income earned by assets held in the trust. Examples include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Interest from bank accounts<\/li>\n\n\n\n<li>Dividend income<\/li>\n\n\n\n<li><a href=\"https:\/\/www.hrblock.com\/tax-center\/income\/real-estate\/rental-income-taxes\/\">Rental income<\/a><\/li>\n\n\n\n<li>Capital gains from investments<\/li>\n\n\n\n<li>Business income; if applicable<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">How form 1041 and Schedule K-1 work together<\/h3>\n\n\n\n<figure class=\"wp-block-table is-style-stripes\"><table class=\"has-fixed-layout\"><tbody><tr><td><strong>Form<\/strong><\/td><td><strong>Purpose<\/strong><\/td><\/tr><tr><td>Form 1041<\/td><td>Reports income, deductions, gains, losses, and distributions of an estate or trust.<\/td><\/tr><tr><td>Schedule K-1 (Form 1041)<\/td><td>Reports each beneficiary\u2019s share of income, deductions, and credits.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">When to file Form 1041<\/h2>\n\n\n\n<p>Taxpayers generally file Form 1041 when an estate or trust earns income that must be reported to the IRS.<\/p>\n\n\n\n<p><strong>Estates<\/strong><\/p>\n\n\n\n<p>An <a href=\"https:\/\/www.hrblock.com\/tax-center\/irs\/forms\/which-form-does-an-estate-executor-need-to-file\/\">estate may need to file<\/a> Form 1041 when:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The estate has gross income of $600 or more during the tax year<\/li>\n\n\n\n<li>A beneficiary is a <a href=\"https:\/\/www.hrblock.com\/expat-tax-preparation\/resource-center\/filing\/status\/what-is-a-nonresident-alien\/\">nonresident alien<\/a><\/li>\n<\/ul>\n\n\n\n<p>After death, a separate taxable entity called an estate is automatically created. Any income earned by the estate during administration may need to be reported on a 1041 tax return.<\/p>\n\n\n\n<p><strong>Trusts<\/strong><\/p>\n\n\n\n<p>A non-grantor trust* may need to file Form 1041 when:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The trust has taxable income for the year<\/li>\n\n\n\n<li>The trust has gross income of $600 or more<\/li>\n\n\n\n<li>A beneficiary is a nonresident alien<\/li>\n<\/ul>\n\n\n\n<p>*A non-granter trust is a trust that is treated as a separate entity for income tax purposes.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Who has to file a 1041 tax form?<\/h2>\n\n\n\n<p>The fiduciary responsible for managing the estate or trust must file Form 1041 when the filing requirements outlined above are met.<\/p>\n\n\n\n<p>For an estate, the fiduciary may be:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>An executor<\/li>\n\n\n\n<li>An administrator<\/li>\n\n\n\n<li>A personal representative<\/li>\n\n\n\n<li>Another person in charge of the estate\u2019s property<\/li>\n<\/ul>\n\n\n\n<p>For a trust, the trustee is generally responsible for filing the return. The trustee of a non-grantor trust must obtain an Employer Identification Number (EIN) for the trust.<\/p>\n\n\n\n<p>Before filing an estate return, the fiduciary typically needs to obtain an EIN for the estate, since the deceased person\u2019s Social Security number is not used on the estate\u2019s return.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">When is Form 1041 due?<\/h2>\n\n\n\n<p>The due date for Form 1041 depends on whether the estate or trust operates on a calendar year or fiscal year.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Form 1041 due dates<\/h3>\n\n\n\n<figure class=\"wp-block-table is-style-stripes\"><table class=\"has-fixed-layout\"><tbody><tr><td><strong>Tax year type<\/strong><\/td><td><strong>Due date<\/strong><\/td><\/tr><tr><td>Calendar year trust or estate<\/td><td>Tax Day (usually April 15)<\/td><\/tr><tr><td>Fiscal year trust (rare) or estate<\/td><td>The 15<sup>th<\/sup> day of the 4<sup>th<\/sup> month after the close of the tax year.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>The fiduciary can extend the filing deadline for five and one-half months for all Forms 1041 (except bankruptcy estates). Schedule K-1 forms should generally be furnished to beneficiaries by the same deadline.<\/p>\n\n\n\n<p>If an estate remains open for multiple years, a Form 1041 generally must be filed each year that filing requirements are met.
