It’s my ex-spouse’s year to claim our child, but our child lived with me all year. I want to file as head of household. Can I do this?

If you signed a Form 8332 to release the exemption, your ex-spouse will have the right to claim the child for these:

  • Child tax credit
  • Dependency exemption

Since your child lived with you longer during the year, you’re considered the custodial parent. So, you might be qualified for these:

  • Head of household filing status
  • Earned Income Credit (EIC) and child and dependent care credit

You’ll still want to make sure you’re not violating your divorce decree.
